Guideline On Limited Warranty Obligations of
Hanover Marine, LLC
Dear Dealers,
This Guideline is provided to clarify the obligations of Hanover Marine,LLC under its limited warranty for boats manufactured after July 29, 2010 and the complete lack of responsibility of Hanover Marine, LLC for any remaining warranty that may exist on any Tartan and C&C Yachts branded yachts manufactured by other entities before July 29th, 2010.
Hanover Marine, LLC. was formed and then purchased the assets (Inventories, molds, plugs, trademarks, licenses, etc.) from the prior owner of those assets and assumed a limited number of lease and financial obligations. No liabilities were ever assumed from any entity that manufactured yachts bearing the Tartan and C&C Yachts brands. Rather, any liabilities, including warranty obligations, remain with the builders of such yachts manufactured before July 29, 2010.
Attached is a schedule showing our understanding of the entities that built yachts under licenses for the trade names Tartan and C&C Yachts for the following periods:

Hanover Marine, LLC. will not accept any warranty claims, transfers of warranty or any offers to purchase an extended warranty on boats manufactured before July 29th, 2010. In explaining that these entities bear the obligation to support any remaining warranty on yachts which they manufactured, it is helpful to recognize that Hanover Marine did not receive any proceeds from the sale of those yachts and, thus, no warranty reserve is available to Hanover Marine to fund warranty service. This is a fundamental aspect of any warranty program. Thus, the responsibility for any remaining warranty remains with the entity that manufactured and sold the yachts and which received the proceeds of such sales. Notwithstanding, on a good will basis, Hanover Marine will continue providing technical information, recommendations and sourcingsuggestions for the owners of yachts purchased prior to July 29th, 2010.
For yachts manufactured and/or sold after July 29th, 2010, Hanover Marine, LLC. will, of course, honor the published warranty as written. It is required that the owner has completed and submitted properly all Hanover Marine, LLC owner warranty registrations to Hanover. In addition, in accordance with the instructions and guidelines of the manufacturers of component parts all warranty registration cards must be submitted to the appropriate manufacturer.
This guideline should clarify the limited warranty obligations for which Hanover Marine is responsible in your dealings with your clients. Should there be any additional questions please contact your Tartan Marine Company representative.
